Terms and Conditions for Users/Customers

1. Introduction

1.1. By using Waterfront Concierge and/or making a purchase on the platform, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1.2. Waterfront Concierge is based in Cape Town, South Africa. Therefore, any contract to buy Waterfront Concierge products will be covered by the laws of South Africa.

2. Product Information and Liability

2.1. We have done our best to ensure that all information on the site is up to date and accurate, but we do not guarantee its accuracy.

2.2. Neither the products nor any information given on the website are intended to, or claim to, diagnose, treat, alter, cure, or prevent any skin disease or condition. You use Waterfront Concierge products entirely at your own risk.

2.3. Waterfront Concierge shall not be liable under any circumstances for any injury, property damage, or loss resulting from the misuse of information or products sold on the site.

2.4. Given the organic nature of certain products, all Waterfront Concierge products are made in small batches to ensure premium quality. Inconsistencies and minor variations will occur from batch to batch, which is considered normal and will be accepted by you as the buyer.

3. Intellectual Property

3.1. We have carefully crafted our Waterfront Concierge brand, including names, logos, trademarks, images, illustrations, designs, icons, photographs, and written materials on the website. These are the intellectual property of Waterfront Concierge, and you may not copy or use them without our permission.

4. Privacy

4.1. Your privacy is important to us, and we will never share your personal information.

4.2. We reserve the right to contact you directly via e-mail when we deem it necessary, including to offer you any personalized information or rewards.

5. Pricing and Orders

5.1. All prices are quoted in South African Rand and do not include Value Added Tax (VAT) as we are not VAT registered.

5.2. When you place an order, you agree to our terms and conditions, and we agree to deliver your products as long as they are paid for and are in stock.

5.3. As a rule of thumb, we don’t accept returns given the fresh nature of our products. However, if we have made a mistake with your order or the product is defective or damaged, please contact us at info@waterfrontconcierge.co.za within 5 days after receiving your product(s). We do offer exchanges, equal to the initial purchase price, based on a case-by-case evaluation.

6.1. We may need to update these terms from time to time. We reserve the right to do so and post them here.


Terms and Conditions for Vendors

1. Introduction

1.1. By registering as a vendor on Waterfront Concierge, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

1.2. Waterfront Concierge is based in Cape Town, South Africa. Therefore, any contract to sell products through Waterfront Concierge will be covered by the laws of South Africa.

2. Vendor Registration and Listings

2.1. Vendors must sign up on Waterfront Concierge to list their products and services.

2.2. Vendor registration is free.

2.3. Waterfront Concierge reserves the right to review and approve or reject vendor applications at its sole discretion.

2.4. Vendors are responsible for providing accurate and up-to-date information regarding their products and services.

2.5. Waterfront Concierge reserves the right to moderate, edit, or remove any listings that violate our policies or guidelines.

3. Commission Fees and Payments

3.1. For each sale made on Waterfront Concierge, the Vendor agrees to pay Waterfront Concierge a commission equal to 10% of the total value of the products or services sold.

3.2. Commission fees will be deducted from the Vendor’s earnings upon each successful transaction.

3.3. Vendors can initiate a payout from the Vendor Dashboard. Payments can be made via Bank Transfer or Paypal, at the Vendors discretion. Please note that any bank charge or service charge will be for the account of the Vendor. A minimum threshold of R250 is in place for a payout to be initiated and successful. This means you need to have at least R250 in sales before you can initiate a payout.

4. Liability and Disclaimers

4.1. Waterfront Concierge acts solely as an online platform connecting Vendors and customers.

4.2. Waterfront Concierge holds no accountability for any loss of sale, income, profits, or any other damages incurred by Vendors due to the use of the platform.

4.3. Vendors are solely responsible for the quality, accuracy, and fulfillment of their products and services. Waterfront Concierge does not warrant or guarantee the products and services offered by Vendors.

4.4. Waterfront Concierge does not guarantee the availability of the platform or uninterrupted access to it.

4.5. Waterfront Concierge shall not be liable under any circumstances for any injury, property damage, or loss resulting from the misuse of information or products sold on the site.

4.6. Waterfront Concierge uses the strongest possible encryption to protect personal data, but the Internet isn’t 100% secure, so customers transmit data at their own risk.

5. Indemnification

5.1. Vendors agree to indemnify and hold harmless Waterfront Concierge, its affiliates, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of or related to the Vendor’s use of the platform or any violation of these Terms and Conditions.

6. Termination

6.1. Waterfront Concierge reserves the right to terminate any vendor’s account or access to the platform at its sole discretion.

6.2. Vendors may terminate their accounts by providing written notice to Waterfront Concierge.

7.1. We may need to update these terms from time to time. We reserve the right to do so and post them here.
